Lawyer claims defendant was hurled down a flight of stairs

A PUB doorman hurled a reveller down a flight of stairs, Newbury magistrates were told.

The extraordinary claim was made by a lawyer on behalf of 18-year-old Jamie Young, of Shelley Road, Thatcham, who ended up being charged with a racially aggravated offence.

Helen Waite, prosecuting on Thursday, September 24, said a police officer on patrol saw two men being escorted from Document House in Newbury town centre at around 2.15am.

She added: “This defendant was quite animated and let his mouth run away with him. He repeatedly used pejorative racial terms, shouting: ‘You’re not even from this country’.”

Mr Young was repeatedly warned by the officer to stop but he persisted and was eventually arrested, magistrates were told.

Ms Waite said: “In interview he exercised his right to silence.”

Mr Young admitted using racially aggravated, threatening or abusive words or behaviour on August 23.

He has no previous convictions but one youth caution, the court was told.

Adonis Daniel, defending, told magistrates that, from the prosecution account, they would “think Mr Young was a raving lunatic, ranting for the hell of it”.

He added: “What, in fact, happened, was that his friend was being ejected and the door superviser threw his friend downstairs. Not many people were around and no one approached the officer to say they were unhappy with his behaviour.

“It was the officer, who had been chatting to the door superviser, who took it upon himself to arrest him.”

However, presiding magistrate Ian Martin reminded Mr Young: “You were told three times to behave.

“You ignored it and now you will pay the penalty for that, and for the language used. It will have been a costly night out.”

Mr Young was made subject to a 12-month conditional discharge and ordered to pay a £150 criminal courts charge, £85 costs and a £15 victim surcharge.
