But when they stopped 73-year-old Richard Rowles, the court was told, he was unable to provide a breath sample due to his smoking habit.
Instead, said Claire French, prosecuting, he provided a blood sample which showed 154ml of alcohol per 100ml of blood in his system.
The legal limit is 80ml.
Mr Rowles, of Groveland Road, Speen, admitted driving a BMW car on Oxford Road in Newbury on October 4 last year after drinking more than the legal limit.
Mr Rowles represented himself in court and handed in a written mitigation, which was not made public.
After reading this, magistrates banned him from driving for 16 months, fined him £150 and ordered him to pay £85 costs with £20 surcharge.
