Man in “intractable” pain defaced cell wall





The allegation was made on Thursday, March 27, on behalf of Sean Edward Milligan of Howarth Court, The Nightingales, That cham.
Claire French, prosecuting, said the 22-year-old had damaged the cell wall at Newbury Police Station after being arrested for an unspecified offence last September 23. Mr Milligan admitted causing criminal damage.
Steve Molloy, defending, said his client suffered from chronic pancreatitis and endured “intractable, almost constant, pain” as a result.
He claimed police had refused him his pain medication, and added: “The police had him in a bare, brightly lit cell. He wasn’t permitted reading materials or, indeed, anything to take his mind off the pain.
“For hours he was sitting in pain, his medication refused him. To take his mind off it, he played noughts and crosses with himself on the cell wall.”
Magistrates made Mr Milligan subject to a 12- month conditional discharge and ordered him to pay £100 compensation for the damage with a statutory £15 surcharge.
