Motorist embeds car in the back of HGV, court told





The court was told how Dominic Robert Utton’s Renault Clio was “buried” in the HGV’s trailer; both air bags had been deployed and and the 22-year-old sustained a broken hand in the crash.
Helen Gambrill, prosecuting, said the drama happened at 12.30am on the A339 Winchcombe Road in Newbury as the HGV driver dropped off a passenger, switching on his hazard lights as a warning.
She added: “The driver said in a statement that he heard a sudden screech as a car came round the roundabout and ploughed into the rear of his trailer. The front of the car was buried in it, causing about £500 worth of damage to the lorry.”
Tests later showed 83mg of alcohol per 100ml of blood in Mr Utton’s system. The legal limit is 80mg. Mr Utton, of London Road, Newbury, admitted driving after drinking more than the legal limit on July 16 this year.
Mike Davis, defending, said: “He had been to a barbecue and consumed two cans of beer and a small glass of wine. He made a mistake about the rate of elimination of alcohol from the body.”
He pointed out that, although the incident was his client’s fault, Mr Utton had already suffered financially due to the loss of the car.
Mr Davis said: “The car, valued at £4,400, was written off. It was more or less embedded in the back of the lorry.
The insurance company may not pay out and he lost wages as well.” Magistrates banned Mr Utton from driving for 12 months. He was also fined £215 and ordered to pay £85 costs with a £20 surcharge.
