The 40-year-old, of Stoney Lane, Thatcham, was charged with being in charge of a Mercedes Vito in Bracknell on Friday, May 31, after drinking more than the legal limit.

Tests are said to have shown 49mcg of alcohol per 100ml of breath in his system.

The legal limit is 35mcg.

At a previous hearing Mr Peaty spoke only to confirm his details and to plead not guilty to the single charge.

At Monday’s hearing he was told the prosecution would offer no evidence in the case and the charge was formally dismissed.
